These terms cover your use of thisisash.com. They are not the terms I work to on projects. If you hire me, the work is governed by a separate written agreement, and section 6 explains how the two fit together.

Who I am

thisisash.com is operated by THISISASH LTD, a company registered in England and Wales under company number 12230369, with its registered office at 1 Daws Place, Redhill, Surrey, RH1 2NZ, United Kingdom.

In these terms, "I" and "my" refer to THISISASH LTD. You can reach me at ash@thisisash.com.

1. Using this site

By using this site you accept these terms. If you do not accept them, please stop using the site.

You agree not to:

  • Use the site for any unlawful purpose

  • Attempt to gain unauthorised access to the site, its server, or any connected system

  • Introduce malicious code, or attempt to disrupt or overload the site

  • Scrape, mine, or systematically extract content from the site, including for the purpose of training machine learning models, without my written permission

  • Copy, republish, or reuse any content from the site except as set out in section 2

I may restrict or withdraw access to the site if I reasonably believe you are doing any of these things.

2. Content and intellectual property

The design, layout, code, written content, and branding of this site belong to THISISASH LTD or are used under licence.

The project work shown on this site was made for clients. Rights in that work usually sit with the client who commissioned it, and it appears here with their agreement. Nothing on this site transfers any rights in that work to you, and nothing here gives you permission to reuse it.

You may view the site, and share links to it. You may not reproduce, distribute, adapt, or use any content from it commercially without written permission from me and, where the work belongs to a client, from them.

If you believe something on this site infringes your rights, email me at ash@thisisash.com and I will look into it promptly.

3. Video content

Videos on this site are hosted by FrameRate and shown through an embedded player. Playback is subject to FrameRate's own terms and privacy policy, which I do not control. Section 3 of my privacy policy explains what data the player shares.

4. Accuracy and availability

I keep this site up to date as best I can, but I make no promise that everything on it is current or complete. Case studies describe work as it was delivered at the time. Nothing on this site is professional advice, and you should not rely on it as though it were.

I do not guarantee that the site will always be available or uninterrupted. I may change, suspend, or withdraw any part of it without notice.

5. Links and third-party services

This site links to other websites and uses services provided by third parties. I am not responsible for their content, their terms, or how they handle your data. Following an external link is your own decision.

6. Enquiries and project work

Nothing on this site is an offer to provide services, a quote, or a fixed price. Rates, timings, and availability shown or discussed informally are indicative only.

Any work I take on is covered by a separate written agreement or accepted proposal between THISISASH LTD and the client. That document sets out the scope, deliverables, fees, payment terms, ownership of the work, what happens to project and source files, revisions, cancellation, and confidentiality. Where anything in that agreement differs from these terms, the agreement wins.

Sending me an enquiry does not create a contract, and I may decline any project.

7. Liability

Nothing in these terms limits or excludes my liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, and because this site is provided free of charge for information:

  • I am not liable for any business losses arising from your use of the site, including loss of profit, loss of business, loss of contracts, loss of anticipated savings, or loss of data

  • I am not liable for any loss caused by a third-party service used on or linked from the site

  • I am not liable for loss that was not reasonably foreseeable when you used the site

My liability in connection with this site, however it arises, is limited to £100 in total.

This section does not affect liability under any separate project agreement, which is dealt with in that agreement.

8. Business use

The services described on this site are offered to businesses, agencies, studios, and other organisations, not to consumers. If you are engaging me as a private individual rather than in the course of a business, tell me before we start so we can agree terms that reflect that.

9. Privacy

How I handle personal data is set out in my privacy policy.

10. Changes to these terms

I may update these terms from time to time. The current version is always the one published here, with the date it was last updated shown at the top. Please check the page when you use the site.

Changes take effect from the date they are published. They do not change the terms of any project agreement already in place.

11. Governing law

These terms, and any dispute arising out of them or your use of this site, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
